Items must be returned in original, as-shipped condition with all original packaging and no signs of use. Buyer assumes responsibility for all return shipping costs unless the item was not received as described.

TERMS AND CONDITIONS SALE OF TEKWERK PRODUCTS
THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU.PLEASE READ IT CAREFULLY. BY ORDERING AND USING A PRODUCT SOLD BY TEKWERK INSTRUMENTS, LLC, YOU ACCEPT AND ARE BOUND BY THESE TERMS AND CONDITIONS.
1. Application. These terms and conditions (these "Terms") apply to the purchase of any Tekwerk Product (the “Product”), whether sold through our website, www.tekwerk- instruments.com, or through www.Reverb.com, or through any other source, platform, or website (collectively, the "Site"). Review these Terms before purchasing or using the Product. Your use of the Product will constitute your acceptance and agreement to these Terms. If you do not agree to these Terms, please contact us for an RMA number to return the unused Product.
2. Order Acceptance and Cancellation. Any Product order is an offer to buy the Product under these Terms. All orders must be accepted by us, or we will not be obligated to sell the Products. In our discretion, we may choose to reject orders even if we send you a purchase confirmation.
3. Shipments; Delivery; Title and Risk of Loss. Title and risk of loss pass to you upon our transfer of the products to the carrier/delivery. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.
4. Returns and Refunds. Except for any Products designated as final sale or non-returnable, we will accept a Product return for a refund of your purchase price, less the original shipping and handling costs provided such return is made within 14 days of delivery date valid proof of purchase and provided such Product is returned unused and in original condition. To return products, you must contact us to obtain a Return Merchandise Authorization ("RMA") number before shipping your product. No returns of any type will be accepted without an RMA number unless you specifically state with your return that you reject these terms. You are responsible for all shipping and handling charges and bear the risk of loss on shipment of all returned items. We recommend you fully insure your return shipment against loss or damage and use a carrier that provides proof of delivery for your protection. Refunds will generally be credited back to the same payment method used to make the original purchase. For defective returns, please refer to the Warranty section below.
5. WARRANTY. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THIS LIMITED WARRANTY CAN ALSO BE FOUND AT WWW.TEKWERK- INSTRUMENTS.COM/WARRANTY. WE WARRANT THAT, DURING THE WARRANTY PERIOD (as defined below), THE PRODUCT PURCHASED FROM US WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP. THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. OUR RESPONSIBILITY FOR DEFECTIVE PRODUCTS IS LIMITED TO REPAIR, REPLACEMENT OR REFUND AS SET FORTH IN THIS WARRANTY. SOME STATES DO
NOT ALLOW LIMITATIONS ON THE DURATION OF AN IMPLIED WARRANTY, SO THE FOREGOING LIMITATION MAY NOT APPLY TO YOU.
i. Who May Use This Warranty? This warranty extends only to the original purchaser of Products. It does not extend to any subsequent or other owner or transferee of the Product.
ii. What Does This Warranty Cover? This warranty covers defects in materials and workmanship in Products purchased from us during the Warranty Period (as defined below).
iii. What Is Not Covered By This Warranty? This limited warranty does not cover any damages due to: transportation; storage; improper use; failure to follow the product instructions or to perform any preventive maintenance; modifications; unauthorized repair; external causes such as accidents, abuse, or other actions, or events beyond our reasonable control; combination or use with any products, materials, processes, systems or other matter not expressly authorized by Us; or normal wear and tear.
iv. What Is the Warranty Period? This “Warranty Period” starts on the date of your purchase and lasts for one (1) year from the date of purchase. The Warranty Period is not extended if we repair or replace a warranted Product. We may change the availability of this warranty at our discretion, but any changes will not be retroactive.
v. What Are Your Remedies Under This Warranty? With respect to any defective Products, during the Warranty Period, we will, in our sole discretion, either: (i) repair or replace such Products or the defective part free of charge or (ii) refund the purchase price of such Products. We will also pay for shipping and handling fees to return a repaired or replacement Product to you if we elect to repair or replace the defective products.
vi. How To Obtain Warranty Service? To obtain warranty service, you must visit www.tekwerk-instrumens.com/warranty; or email ([email protected] our Customer Service Department during the Warranty Period to obtain an RMA number. No warranty service will be provided without an RMA number.
6. Limitation of Liability. THE REMEDIES DESCRIBED IN THE WARRANTY SECTION ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF WARRANTY.OUR LIABILITY WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR WILL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY LOSS OF PRODUCTION, WORK, USE, BUSINESS, GOODWILL, REPUTATION, REVENUE OR PROFIT, ANY DIMINUTION IN VALUE, COSTS OF REPLACEMENT GOODS OR SERVICES, OR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE FOREGOING LIMITATION OR EXCLUSION MAY NOT APPLY.
7. Goods Not for Resale or Export. You represent and warrant that you are buying the Products for your own personal or household use only, and not for resale or export. You further represent and warrant that all purchases are intended for final delivery to locations within the US.

8. Intellectual Property Use and Ownership. By Purchasing, retaining, and using the Product, You acknowledge and agree that Tekwerk Instruments, LLC, is and will remain the sole and exclusive owner of all intellectual property rights in and to the development of each Product and all related copyrights, patents, and trademarks, and other intellectual property rights, related to the Product, not including the actual Product purchased by you.
9. Force Majeure. We will not be liable or responsible to you, nor be deemed to have defaulted under these Terms, for any failure or delay in our performance caused by circumstances beyond our control, including, without limitation, acts of God and acts of government.
10. Governing Law; Jurisdiction; Dispute Resolution. All matters arising out of or relating to the Product(s) or these Terms are governed by Florida Law and the exclusive venue for any disputes regarding the Product or these terms is Seminole County, Florida. All disputes shall be heard and determined by a judge, not a jury. EACH PARTY WAIVES THE RIGHT TO A JURY TRIAL IN ANY CLAIM RELATED TO THESE TERMS OR THE PRODUCT(S). In the event of any disputes related to the Product or these Terms, you first agree to contact us to engage in face-to- face negotiations to occur in person or via video conference.
11. Assignment; Third Parties. Your rights under these Terms cannot be assigned without our prior written consent. These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
12. Interpretation and Modification. These Terms will be deemed the final and integrated agreement between you and us on the matters related to the Product(s). If any provision of these terms is determined by a competent court to be unenforceable, such invalid provision shall be severed, but shall not affect the enforceability of the balance of the Agreement. This Agreement may not be altered, amended, modified, or otherwise changed, except in writing executed by Us. The failure to seek redress for breach or to insist upon the strict performance of any covenant or condition of these Terms shall not be deemed a waiver unless expressly stated in writing.
13. Notices. To give us notice under these Terms, you must contact by personal delivery, overnight delivery, or certified mail to Tekwerk Instruments, LLC: P.O. Box 284, Deland, FL 32721-0284. We may update the address for notices to us by posting a notice on our website, www.Tekwerk- Instruments.com. We may provide any notice to you under these Terms by sending a message to the email address you provide when you purchase or by posting to the website, www.Tekerk- instruments.com.
